Espero haberme explicado bien.

«Further to the official implementation of the Entry/Exit System (EES), we wish to bring to your immediate attention a critical regulatory update issued on 10/04/2026 by the Italian Border Police, introducing an unannounced enforcement measure affecting non-EU crew movements within the Schengen Area.
This development represents a significant operational change for all vessels calling at Genoa (And Italy/EU in general) and requires immediate consideration when planning crew rotations.
The below, are operational details related to the port of Genoa (Portofino, Santa Margherita Ligure and Rapallo), we are in touch with the other Italian ports to check if this EU enforcement, is applied in the same operational procedure by the local immigration offices.
New Enforcement Rule:
Non-EU crew members arriving by land (already stamped INTO the Schengen Area) may no longer be stamped OUT unless the vessel’s departure is officially confirmed within 10 days.
Please note that embarkation itself is not prohibited. As per standard procedure, agencies will continue to submit the formal PEC (legal mail) notification of embarkation to the Authorities. However, in the absence of a confirmed vessel departure within 10 days, the Border Police will not proceed with the OUT stamp, meaning the crew member will remain legally within the Schengen Area despite being onboard, thus, using his/her days granted by the passport (such as UK citizens for example) or the days granted through a C Visa.
Such departure must be demonstrable and will be subject to verification by the competent Authorities.
Operational Clarification:
By way of example: should a non-EU seafarer arrive today to join a vessel scheduled to depart in 30 days, the crew member will be registered in the Police system but will not receive the OUT stamp at the time of embarkation.
As a consequence, their Schengen stay (90-day allowance) will continue to run despite being onboard.
Crew members holding a valid Type D visa are not subject to this limitation, as their legal stay follows the duration and conditions of their employment contract.
Once the vessel’s departure date falls within the 10-day window, we will then be able to arrange a dedicated appointment with the Border Police to regularize the position of all crew members embarked during this period, allowing the OUT stamps to be issued accordingly.
Additional Operational Requirement:
For any embarkation or disembarkation of non-EU crew members not holding a valid Type D visa, it is now mandatory to obtain an appointment with the Border Police before the operation can take place.
Exposure & Risk Areas:
Particular attention should be given to:
– Crew holding Schengen visas expiring prior to the vessel’s departure
– Crew approaching or exceeding the 90-day Schengen allowance
– Visa-exempt non-EU nationals nearing the limit of permitted stay
Failure to comply may result in overstay situations, with potential implications on future Schengen access and visa eligibility (up to 3 year ban from the EU).
Current Crew Status:
Crew members already embarked and stamped out of Schengen retain their seafarer status until disembarkation. However, any subsequent re-embarkation will be subject to the above-mentioned 10-day rule.»
